These Terms of Service ("Terms") govern your use of the ClearList platform operated by Cuneiform LLC ("ClearList," "we," "us," or "our") at clearlist.me. By creating an account or using our services, you agree to these Terms. If you do not agree, please do not use ClearList.

1. Overview of the Service

ClearList is an AI-powered platform that helps sellers create and manage moving sales online. Sellers photograph items, receive AI-generated listings, and publish a shareable sale page. Buyers browse sale pages, reserve items, and coordinate pickup with the seller. ClearList is a platform that connects sellers and buyers — we are not a party to any transaction between them.

2. Eligibility

You must be at least 18 years old to create a seller account. Buyers must be at least 16 years old to reserve items. By using ClearList, you represent that you meet these age requirements.

3. Accounts

  • Seller accounts are created using passwordless email authentication (6-digit code). You are responsible for maintaining access to the email address associated with your account.
  • Buyers do not need accounts. Buyers verify their email address when making a reservation.
  • You may not create multiple accounts to circumvent usage limits or for any fraudulent purpose.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Seller Responsibilities

  • You are responsible for the accuracy of your listings, including item descriptions, condition, and pricing.
  • AI-generated listing details (title, description, price suggestions, dimensions, weight) are estimates. You should review and edit them before publishing.
  • You must only list items that you own and have the legal right to sell.
  • You must not list prohibited items, including but not limited to: firearms, weapons, hazardous materials, controlled substances, live animals, stolen goods, or adult content.
  • You are responsible for honoring reservations and coordinating pickup with buyers in good faith.
  • You control when and whether to share your address with buyers. ClearList never shares your address automatically.

5. Buyer Responsibilities

  • When you reserve items, you commit to picking them up within the reservation window (48 hours, or 72 hours if a pickup is scheduled).
  • You must provide a valid email address for reservation confirmation.
  • If you cannot complete a pickup, please cancel your reservation promptly so the next buyer in queue can be notified.
  • Payment for items is arranged directly between you and the seller. ClearList does not process payments for item purchases.

6. Reservation Queue System

  • Items are reserved on a first-come, first-served basis with a maximum queue depth of 3 buyers per item.
  • Reservations expire after 48 hours (or 72 hours if a pickup time is scheduled). Expired reservations are automatically released and the next buyer in queue is notified.
  • Canceling a reservation cancels all items in that reservation. This is not reversible.

7. Pricing and Payments to ClearList

  • Free tier: List up to 5 items for 3 days at no cost.
  • Paid pass: A one-time payment unlocks additional items and features for a fixed period. This is not a subscription and does not auto-renew.
  • Payments are processed securely through our third-party payment provider. Prices are displayed at checkout and include any applicable fees.

8. AI-Generated Content

  • ClearList uses artificial intelligence to analyze photos and generate listing details. AI outputs are estimates and may contain inaccuracies.
  • Price suggestions are based on market data and are not guaranteed. Sellers are responsible for setting their own prices.
  • Dimensions and weight are estimated and include a confidence indicator. Sellers should verify measurements for accuracy.
  • You retain ownership of your photos. By uploading photos, you grant ClearList a license to process, store, and display them as part of the service.

9. Prohibited Uses

You agree not to:

  • Use ClearList for any illegal purpose or in violation of any applicable law.
  • List prohibited items (as defined in Section 4).
  • Circumvent rate limits, usage limits, or security measures.
  • Scrape, harvest, or collect data from ClearList pages without permission.
  • Impersonate another person or misrepresent your identity.
  • Use automated tools to create accounts, make reservations, or interact with the platform, except through officially supported APIs.
  • Harass, threaten, or abuse other users through the messaging system.

10. Intellectual Property

  • The ClearList platform, including its design, code, AI models, and branding, is owned by Cuneiform LLC. All rights reserved.
  • You retain ownership of content you upload (photos, descriptions). By using ClearList, you grant us a non-exclusive, worldwide license to display, process, and store your content as necessary to provide the service.
  • This license terminates when you delete your content or account, subject to reasonable backup and caching periods.

11. Disclaimers

  • ClearList is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee the accuracy of AI-generated content, including pricing, dimensions, or item identification.
  • We are not responsible for the condition, quality, safety, or legality of items listed on the platform.
  • We are not a party to any transaction between sellers and buyers and are not responsible for disputes between them.
  • We do not guarantee that the service will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Cuneiform LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ClearList. Our total liability for any claim related to the service shall not exceed the amount you paid to ClearList in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Cuneiform LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of ClearList, your violation of these Terms, or your violation of any third-party rights.

14. Termination

  • You may delete your account at any time by contacting us at hello@clearlist.me.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your sale page will be taken offline and your data will be handled in accordance with our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the United States. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of ClearList after changes constitutes acceptance of the updated Terms. For significant changes, we may also notify you via email.
